The International Criminal Court is seeking to issue arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Hamas leader Yahya Sinwar in Gaza for their actions in Israel’s ongoing war.
An ICC panel will consider Prosecutor Karim Ahmed Khan’s request for arrest warrants, which also include Israeli Defense Minister Yoav Galant, as well as two other senior Hamas leaders, Mohammed Diab Ibrahim al Masri, known as Mohammed Deif, as well as Ismail Haniyeh.
The charges against Netanyahu and Galant included causing genocide, causing famine as a means of warfare, including denying humanitarian relief supplies, and deliberately targeting civilians in the conflict.
If the panel acceded to Khan’s request and issued arrest warrants, the 124 countries that have signed the Rome Statute of the International Criminal Court would be obliged to arrest the men and extradite them to The Hague, the Netherlands, if they travel internationally.
There are major exceptions to the treaty, including the states of Israel, the United States and Russia.
However, some of Israel’s closest allies, including Germany and the United Kingdom, have signed the Rome Statute, which was adopted by the International Criminal Court in 1998 and entered into force in 2002.
